ZBA Public Meeting - April 27, 20917
NOTICE IS HEREBY GIVEN that a public meeting will be held by the Zoning Board of Appeals of the Town of Vestal, Broome County, New York in the Board Room located at 605 Vestal Parkway West,Vestal, New York, 13850 on Thursday, April 27, 2017 to consider the following requests for an interpretation and/or variance and/or special permit as follows:
1) At 6:00 p.m. A special permit has been applied for by Up State Tower Co., LLC, Tax Map #158.09-1-12 also known as 2305 Vestal Road, Vestal, New York as required under Chapter 24, Article IV, Division 1, Section 24-152 and further described in Chapter 24, Article V, Division 2, Section 24-327, of the Code of the Town of Vestal, Broome County, New York, pertaining to construction and operation of a commercial transmission tower and facility in an “I”, Industrial zoning district. The applicant requests an approval to construct a one-hundred-sixty foot, self-supporting tower at the address noted. As proposed, the applicant will need variances to the following: Chapter 24, Article V, Division 2, Section 24-327(2) & (4) for distance to property boundaries.
2) At 6:45 p.m. A permit to alter an existing building to create a five story multiple residence building, has been denied to: Tax Map #157.58-2-6 located at 860 Vestal Road, Vestal, New York also known as 860 Vestal Empire LLC for nonconformity with the following: Chapter 24, Article IV, Division 2, Section 24-182: (b)(1) pertaining to having less than the minimum lot area for the number of dwelling units proposed in a multiple residence. (c)(1)(a) pertaining to creating a five story building greater than forty feet in height. Chapter 24, Article IV, Division 3, Section 24-206(d) requesting to be able to provide 207 parking spaces, where 256 spaces are required for 128 dwelling units. The requested construction is non-compliant with the Code of the Town of Vestal, Broome County, New York, in an “R-C” Multiple Residence zoning district. The applicant has decided to apply to the Zoning Board of Appeals for relief, and is proposing to create “senior” housing.
In addition to the above scheduled hearings, all previously heard applications to the Zoning Board of Appeals may be discussed by the Zoning Board of Appeals and acted upon, as well as discussion of other Zoning Board of Appeals business.
